www.pet-detect.com is offered to you free of charge for your personal use and is subject to these Terms and Conditions. By using www.pet-detect.com you consent to be bound by the following Terms and Conditions. Please check these T&C's on a regular basis because they do change to reflect any new product,service or legislation. Disclaimer: The Pet Chip Company Ltd, together with all of its associated companies and brand names, does not employ or endorse the microchip implanters that may be named or listed on our web site, and The Pet Chip Company Ltd are not responsible for any work carried out by any microchip implanter. Our recommendation is for you to do your own Due Diligence regarding anyone that you engage as an Implanter. Please note that these Terms and Conditions do not affect your statutory rights. Amendments We may occasionally make changes to our Terms and Conditions. If this concerns you, you are advised to check the current Terms and Conditions prior to every purchase. If you continue to use www.pet-detect.com after the date of a change in our Terms and Conditions, your use of www.pet-detect.com indicates your agreement to be bound by said new Terms and Conditions. To buy microchipsTo register to use pet-detect microchips you must have a valid Implanter Code issued to you by pet-detect or another recognised training company, and must ensure that your details held by us are correct and complete at all times. Copyright and intellectual propertyThe content of www.pet-detect.com aka www.microchipping.com may be protected by copyright, trade marks, and other intellectual property rights. You may retrieve and display the content of www.pet-detect.com on a computer screen, store such content in electronic form on disk (but, excepting search engine computers, not on any server or other storage device connected to a network) or print one copy of such content for your own personal, NON-commercial use, provided you keep intact all and any copyright and proprietary notices. To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to www.pet-detect.com. Our acceptance of an order takes place on receipt of the order, at which point the purchase contract will be made and you will be charged for your order unless the item you have chosen is out of stock or their is an incorrect price listed. If an item has been listed for sale at a price that is incorrect, and once we are made aware of the incorrect price, we will endeavour to rectify the error within a reasonable time-frame but no longer than 24 hours. We reserve the right to void the sales contract if the item listed is palpably incorrect. TRAINING COURSE FEES AND REFUNDS We take payment for our training courses at the point of registration. If you do not pass on the day, or if you cancel, or if you do not attend even though you registered, we will consent to a full refund - LESS the PayPal processing fee charged on the original course booking order, which is normally around 3.4% of the order total. We have to pay this to PayPal regardless of whether you cancel or not, therefore this cost will be borne by the person cancelling the course. If you pay by cheque we will cash the cheque upon receipt, and we will apply the same refund policy to cheques with the exception of the PayPal processing fee which does not apply for cheques.. For those paying by cheque, we will hold your place on the course open for 7 days, so that you can send us your cheque. If we do not receive your cheque within 7 days of your registration, you will loose your place on the course. We are not obliged to remind you to send your cheque. All payments received will be acknowledged by an emailed receipted invoice. If you do not provide an email we will post your receipted invoice to you. Please keep a copy in case there is a query at a later stage. Third Party WebsitesAs a convenience to our customers, www.pet-detect.com includes links to other web sites or material which are beyond its control. The Pet Chip Company Ltd is not responsible for this external content, or for any other web site outside of www.pet-detect.com. Applicable LawThese Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts. Non Payment of the Training Course FeeIf we are unable to obtain payment for your training course fee, we reserve the right to withhold your Implanter Code. PricesWe will make all reasonable efforts to present accurate information but we cannot guarantee the price or our ability to supply any particular item. All prices shown on www.pet-detect.com do not constitute an offer to sell. until we formally accept your order; your placement of an order will constitute simply an offer to purchase. We will confirm your place on our Training Course in an email. Your registration for the course is not confirmation in itself - please wait for an official and separate confirmation. Occasionally our suppliers may increase their prices unexpectedly, and this is often something we become aware of only upon ordering further stock from them. In the event that this occurs, or in the event of a pricing error, howsoever caused, we will check with you to see if you still wish to receive the item at the new price. All prices are displayed in pounds sterling (£), and VAT and postage are shown where applicable. AvailabilityIf for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. You can also select to have the item removed from your order if you do not wish to accept an alternative product - should one be available. Substituted lines will normally be of identical or higher value than the original item ordered. In cases where the replacement item is of differing value, you will be charged the lesser of the two prices. Where a change to your order contents occurs, you will be notified by email or telephone. If it is impossible to substitute an item, we will remove the item from the order and deduct the item price from the total order cost accordingly. For most orders placed Monday to Friday this will mean same day dispatch. We can make alterations to your order up to the point of dispatch, however, once dispatched any changes to your order will have to be made via our standard returns process (below). Acceptance & ContractThere will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us. PaymentOur web site is as secure as possible, and we comply to legislation to ensure it’s security, however any breach of security or fraudulent activity concerning your credit card details or personal details is out of our control, and we cannot be held responsible, culpable, or negligent in any way whatsoever. DeliveryAll our deliveries are carried out using the external carriers of either couriers, Parcel Force or Royal Mail depending on choice. As such we are subject to their terms and conditions. We may change these companies without notice. Once your order has been received by us, we aim to dispatch your goods within 3 business days (Mon-Fri) although we will try our best to make this next day delivery. However dispatch is subject to stocking levels, and for certain items such as bespoke scanners there may be a long lead-time. In such cases we will contact you for further instruction. Once we have dispatched your goods, you should normally receive them within the timeframe of the delivery type chosen. However, while we maintain a close relationship with our delivery companies, and will attempt to rectify any delivery problems as soon as reasonably possible, the operation of the delivery companies we use is outside our control. Time of delivery shall not be subject to any contractual obligation, and The Pet Chip Company Ltd does not offer any guarantee that your order will arrive within the delivery time-frame chosen. In the event of the delay of delivery of your order or a mistake in the order itself, The Pet Chip Company Ltd accepts no liability for any associated expense, loss of profits or other losses incurred whatsoever. Failure to deliver on time will not entitle the customer to terminate their purchase contract with The Pet Chip Company Ltd, or refuse the delivery. Returns should be made using the instructions below. Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full, due to circumstances beyond our control. Delivery will be made to the address specified by you on the completed order form. We reserve the right to charge for any extra carriage costs incurred should the incorrect address by entered on your order. Until dispatch of your order please contact us to amend or add any delivery details. Please note that The Pet Chip Company Ltd will not be responsible for any lost or damaged parcel as a result of incomplete or inaccurate address supplied to us by you or your colleagues. The Pet Chip Company Ltd can only be responsible for delivery to an address that has been registered with Royal Mail (www.royalmail.com). We cannot guarantee delivery to any address that is not registered with The Royal Mail. Our couriers deliver to 95% of the UK with only 5% being deemed by them as 'A Remote Area'. We may have to dispatch your order by another means if your address is deemed A Remote Area. Delivery may take longer if this is the case and we cannot be held responsible for this delay. Refunds and ReturnsThe Pet Chip Company Ltd operates a returns policy in accordance with the UK Distance Selling Regulations allowing you to return any item within 7 working days of receiving delivery of your order. Please note that any postage costs incurred when returning your items during this period will be at your own cost, unless the item is damaged, or was sent in error. This policy does not extend to any items which have been opened or whose seal has been broken, and also does not include the refund of services carried out by The Pet Chip Company Ltd as part of your contract (i.e. postage or handling costs). Items must be returned in pristine and resalable condition. This policy does not affect your statutory rights. Returns InstructionsItems supplied to customers should be returned in their original packaging or packing supplied to you by The Pet Chip Company Ltd and sent to: The Pet Chip Company Ltd Please be aware that if returning needles you MUST take extra care in packaging them so that they do not pose a danger to anyone who might handle them. Please make sure you contact us before returning any item. Any item returned without our knowledge will be refused.Please also note that the items remain your property until we have received them. You are therefore responsible for your goods while they are in transit to us. For your own protection we recommend using a secure recorded delivery method such as Royal Mail Special Delivery. Ensure your details are clearly available so that we know who has returned the item. Provided the conditions above are met The Pet Chip Company Ltd will refund the item(s), and postage where applicable. Please note that returns are accepted at the discretion of the Pet Chip Company Ltd. If any goods are returned which do not adhere to the above policy, then we reserve the right to impose a charge proportionate with the costs of processing the items re-sale. Refunds will be given in the same tender type as the original payment. Please allow 28 days (in addition to the delivery time) for the return and refund to be processed. Terms of Payment and Outstanding DebtsOur terms are strictly payment with order - except where we have agreed 30 days on invoice. Very Important Notice Any invoice outstanding beyond the agreed period, unpaid cheques or declined credit cards for training courses and / or goods, will at our discretion, be referred to our Debt Collection Agent, Daniels Silverman Ltd, and will be subject to a surchrge of 20% of the invoice total, plus VAT, to cover the collection costs incurred. This surcharge, together with all other charges and legal fees incurred, will be the responsibility of the customer, and will be legally enforceable. MiscellaneousYou may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. If you breach these Terms and Conditions and The Pet Chip Company Ltd ignores this, The Pet Chip Company Ltd will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. The Pet Chip Company Ltd shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control. A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
